1. INTRODUCTION
1.1 Thank you for visiting www.eka.com.my. These Terms and Conditions apply to all user of the Site and is controlled and maintained by EKA Foodstuff Sdn. Bhd. [(Company No. 201201006464 (979989-X)], a company incorporated in Malaysia and having its principal place of business at Lot 208, Phase II, Kuala Ketil Industrial Estate, 09300 Kuala Ketil, Kedah Darul Aman, Malaysia.
1.2 Your access to the Site is conditional on your acceptance and compliance with the terms and conditions. The content of terms and conditions may be changed, modified, added or deleted without any prior notice at any time. Changes in the terms will be effective when notice of such change is posted on the Site. By using the Site, you agree to be bound by these terms and conditions and any of its changes.

3. LICENCE AND ACCESS

Additional verification or information, including but not limited to contact details may be required from you before acceptance of order.
5.2 We always strive to provide accurate information on the Site at all time. However, in the event of error occurs to product pricing, availability, etc, we reserve the right to correct the information and reject or cancel any order at our end. We shall communicate with you on such cancellation and refund the payment received from you.

The trade marks, copyrights and all intellectual property rights in the Service, all content on the Site, all software and website design shall remain the property of the Company. 7. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions of use shall be interpreted and governed by the laws of Malaysia, and you submit the exclusive jurisdiction of the courts in Malaysia for resolution of any disputes.
8. TERMINATION
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. 9. PRICE AND PAYMENT
9.1 The price and payment of the Products shall be the price displayed on the Site at the time when the purchase is made. The price quoted excludes service tax, delivery charges and cost of packaging.
9.2 All product prices is subject to change in line with Malaysia Government, Customs and excise and other legal interpretations issued by relevant authorities.
9.3 Import duties and local taxes are NOT included in the quoted price of products for delivery outside Malaysia. You will be liable for import duties and any administration charges upon receipt of order.
9.4 We reserve the right to revise the price of our products, add or withdraw any product from the Site without prior notice at any time.
9.5 We accept types of payment as below:

10. Force Majeure
The Company shall not be liable to any delay or failure to perform any of the Company’s obligations results from any circumstances outside the Company’s reasonable control including, but not limited to any fire, flood, explosion, adverse weather conditions, accident, traffic congestion, mechanical breakdown, riot, government act, act of war, terrorism, act of God, or from any industrial dispute or strike whatsoever.
11. NOTICES
A written notice is required by either party to the other under these Conditions by addressing to the Company’s registered office or principal place of business.
12. WARRANTY & REMEDY
The Company shall not be liable on any defect of products arising after the expiry date for consumption.
The company reserves the right to make changes to terms and conditions without prior notice
